License and Usage Info for BittBox Freebies

I provide a lot of free [original] source files on this site, so I think It’s important for you to know exactly what you can do with those files.

BittBox source files (freebie downloads) are original works, and therefore subject to copyright. What does this mean? I’ll tell you: Since the files you download from BittBox.com are my original artwork, they are copyrighted by me with Some Rights Reserved for my protection provided by Creative Commons License, however, there are certain things you can do with them. Here’s what you can and can’t do:

First and foremost you need to understand one thing: Just because it’s free, doesn’t mean it’s copyright free. Every file (and every file contained within those files) I create/give away is copyrighted by me. I own the rights to all of my artwork. Get permission from me if you are unsure about anything. Getting permission is the right thing to do and it will save you a lot of trouble rather than getting caught selling my work.

Terms and Conditions for all BittBox.com Downloads:

1. You may NOT Redistribute BittBox Original Source files from your own site. Specifically, you can not download BittBox original designs, upload them to your own server, and redistribute as your own download, in whole or in part. In order to share BittBox resources, you must link to the BittBox page where the source file is located.

3. You may NOT adapt BittBox’s free source files in order to charge money for them. (This includes vectorizing my brushes)

4. You may NOT take any BittBox file (including zip files) and claim it as your own.

5. You may NOT take any BittBox file and sell it on a stock photography/vector resource site.

6. You may NOT take any BittBox Brush set and vectorize them in order to sell on a stock photography/vector resource site.

7. You may NOT ever copy and paste one of my entire articles on your own site. You may only feature an excerpt on your site and link to mine for the original story. Copying articles in full (even if you link back) is still copyright infringement. Excerpts only please.

By using my files, content, or both you agree to these terms and conditions which are subject to change without notice. Violating these terms and conditions could and will result in punishment to the maximum extent under law.

Do these things:

Use Bittbox files in posters, website designs, cd covers, postcards, annuals, flyers, business cards, branding, . . . DESIGN.

Use BittBox buttons as a part of a UI for a software you are developing.

Use BittBox files as a learning experience to grow and create your own excellent designs.

Take a screenshot or grab an image from one of my posts and link to the post if you want to allow your visitors access to BittBox Files. (hotlinking won’t work, trust me)

  1. Yes, you can use my work in commercial applications without my permission.

  2. Sorry to be picky, but the CC-license you picked does not match what you want your license terms to be.

    According to the CC-License, I could grab your stuff and put it on my server for others to download. (”You are free to Share ? to copy, distribute and transmit the work”)

    This is nothing I want to do, I just want to point out the difference between the intent and the licence.

    And of course: You got some great stuff on your site! Thank you very much for it.

    Yes,it says you are “free to share, transmit, and redistribute,” but right under that it lists “Under These Conditions.” Under the creative commons license I chose (above), the “attribution” section states that you may share and redistribute, but only as the author describes.

    I described above how to share my work. You must point your visitors to BittBox.com to retrieve the original files.

    If you adapt my work, and It’s a fair enough adaptation to be considered original, then you may offer the source files from your own site. Otherwise, as the license states, you must share according to the authors instructions. In my case, simply link the Page on BittBox where the source file is located. Thus sharing via a link, and maybe a screenshot. You may, however, grab any images from BittBox, and host them on your own server. I have no problem with that.

    No. Only if you are sharing source files. If its just a design (image). You have the rights to it. And you may license as you see fit.

    You say we can use your work in commercial applications, but you also say we must only use your work in the same way you gave it to us, ie. Free.

    How does this work?

  11. Because you will be selling your software, not my buttons. If you use my designs as part of a UI that’s fine, you just can’t sell my source files. In other words, my buttons can be a part of your software, so long as you aren’t selling the buttons themselves.

  13. Is it OK to use your brushes to make papers and elements for digital scrapbook kits sold on the internet? Digital scrapbook kits consist of .ZIP files with .png and .jpg files for papers, bow, flourishes, buttons, etc. used to make digital scrapbook pages in Photoshop and other programs (for ex. see http://www.oscraps.com/store)

    First off, great site! I love the stuff you’ve done, and can’t wait until I can upgrade my photoshop 7 to CS so I can really start using your stuff.

    Yes, if you only used my files as part of your design. (you need to change 20% to be original) But this can include the overall composition of the file, not just changing my vectors. In other words, your file/design needs to contain some vectors you made on your own, not just BittBox vectors.
    No, If your image only contains a bunch of my eps files stacked into one file.

    Great site, and I’d like to suggest that you offer a donation box. I have found your brushes very valuable in my illustration work.

    QUESTION: I have read your license and this discussion list, and want to double-check this: I may use your brushes in my work for resale, as long as the work becomes “original” by how the brushes are implemented (line shape, point thickness, combinations, etc.), and use of color, composition and other elements which I create? Correct? I am thinking that one could not somehow resell brushes “as is”, or make a work using the source files with no changes to them.

    OK… now keep up the good work, and please add a donation box.

    Yes you can use my brushes in work you resale. You can not resale the brushes themselves. (in other words, it’s ok as long as you are selling a piece of artwork you created, not just a bunch of my brush strokes)

    I have been looking for programs & help in graphic design when I found this site. After reading the comments, I have a quesrion.
    I digitize embroidery designs and have been trying to find a program that I can use for original graphics that I can digitiz to sell.
    In some cases I would sell an item with the embroidery design put on by me, and in other cases I would be selling the digitized embroidery design for others to use. I am also hoping to do graphice images to sell as clipart for others to digitize. ( I have several friends that want to digitize the designs on their own, but don’t want to draw or design the graphic.)
    Is this something that is allowable under your copyright.
    I am going to download your programs and try them out, but will not do anythisg with them until I know if it is ok or not. If I need to clarify anything, let me know.

    I don’t want to get in trouble with copyright infringement or anything, so I will ask your permission. I am entering a t-shirt design to uneetee.com using some of your foliage and tear drop vectors, but I will also use some of my own original vector elements. Is that ok?

    Yes, you may use the vectors as a part of a t-shirt design.
    And Yes, the Illustrator brushes are merely tools. What you choose to do with them is up to you.

    I’m designing a logo for my band. If I use your brushes or some of the other free things found here, is it ok then to sell things from cafe press (i.e. t-shirts, hats, etc.) with that logo on them?

    Do what ever you wish with the vector brushes because they are a “tool” and whatever you create with them is copyrighted by you. As for the vectors: As long as it’s your own design, meaning not just one of my vectors slapped on a shirt, then you are in the clear.

    You can always email me a jpeg or something when you get done if you’re unsure.

  41. I do some graphic design, mostly logos and custom cards (birth announcements & holiday cards). May I use your brushes for these applications? May I direct my clients to your site if they want to use the brushes for other purposes (background of stationary for example or on their website).

  46. I am a digital scrapbook kit designer. I also design brushes both for personal and professional use. If I were to design photoshop brushes using your illustrator brushes is this ok under your terms.

    To explain better I would say make a flourish design with your brushes and make a brush with that for resale.

    Your brushes are great by the way, I have been having a play and they are great to work with! :-) I would also put a link to your site in my terms of use (included with the set) as well as credit for the use of your brushes.

    That is perfectly OK. What you design WITH the brushes is copyright by you. (the brushes are merely a tool. Design away, even if it happens to be turned into photoshop brushes)

    I’m a weekly guest tutorial writer for PSDTUTS.com. I made a tutorial for a poster design and I would like to use Grungy Paper 2 in the design. We would of course put a link to your post about this freebie in the intro paragraph crediting your work.

    The big issue is that the site offers downloads for sale so users can review the process to make the design. We could watermark the Grungy Paper 2 image with big text that says Bittbox. That way they couldn’t use the image without coming to your site to download it, but they would be able to see the layer effect used to overlay the image and where the image resides in relation to other layers. So they could learn from it.

    Almost don’t want to ask since so much has been covered in the responses! Anyways - I’m experimenting with using one of your grunge backgrounds for a poster to be sold. Ofcourse, 90% and up will be my doing. Just wanted to double check before handing it over to the client. I do totally understand the brushes are cool to use in the process, which I may try, as well.

    Awesome site. I work freelance and don’t get the immediate hands-on inspiration and ideas from working around others, so I access the internet 24/7. It took me less than a minute to bookmark your site. Rock on.

    No need to credit me when you’re only using the files as a part of a larger design. You can credit me for the vectors if you want, but put yourself as the artist for the CD cover.

I have three questions, first, Can I use your free brushes and vectors incorporated into my own artwork and then sell the work on my site? Secondly If I design logos with your free vectors can I offer them for sale on my site, and also is it alright to use your free content to design for individual customers?   78. I recently completed a hypertext fiction piece using artwork created using your BB_gears.eps file. I want to be 100% sure about the copyright issues regarding your work, so I’m asking for permission to use the artwork in “Operation Voodoo,” which will be published in the non-profit online journal, CEllA’s Round Trip. Neither I nor the journal will make money off this publication, your work will not be distributed to others via my hypertext, and I will include a credits page acknowledging you as the creator of the image. The test site can be viewed at http://filebox.vt.edu/users/c11m77/OperationVoodoo/. The credits page, while not currently on the site, will be linked from the homepage of the site. The acknowlegment of your work will read as follows:
